Sendika üyeliğinin güvencesi / Assurance of union membership

Türk sendikacılık hareketinde sendika özgürlüğü ilkesine ulaşma amacı sendika üyelerinin güvencelerinde oluşacak sorunların çözümü ile mümkündür. İşçilerin, işverene karşı haklarını koruması ve bu nedenle dilediği sendikaya üye olması, sendika üyeliğinden ayrılması ve serbestçe kanuni sınırlar içerisinde sendikal faaliyette bulunması hiçbir zaman ve hiçbir koşulda engellenmemelidir. Çalışmamız "Sendika Üyeliğinin Güvencesi" şeklinde adlandırılmıştır. Çalışmamızın ilk bölümünde "Sendika Kavramı ve Sendikal Özgürlükler" başlığı ile sendika, sendika özgürlüğü, kaynaklar, sendikanın unsurları ve sendikanın kuruluşuna yer verilmiştir. Sendika üyeliğinin güvencelerinin öğrenilmesi için bu bölümde anlatılanlar bir başlangıç teşkil etmektedir. İkinci bölümde "sendika üyeliği" önemli görülen konu başlıkları açılmak suretiyle incelenmiştir. Sendika üyeliğinin şartları, üyelik işlemleri, üyelerin hakları ve borçları, eski-yeni kanun karşılaştırılması yapılmak suretiyle incelenmiştir. Önceki düzenlemelere getirilen eleştirilere de yine bu bölümde yer verilmiştir. Çalışmamızın üçüncü bölümü "Sendika Üyeliğine Bağlı Güvenceler" başlığıyla incelenmiştir. Bu başlık çalışmamızın ana konusunu oluşturmaktadır. Bu bölümde güvence kavramından, işçinin işe alınma, çalışma süresince ve iş sözleşmesinin sona ermesi sırasında sendika üyeliği ve güvenceleri önceki ve yeni düzenlemelerle karşılaştırılmak ayrıca doktrinde görüşler ve Yargıtay kararları da belirtilmek suretiyle incelenmiştir.

In the Turkish trade union movement, it is possible to solve the problems that will arise in the trust of the union members in order to achieve the principle of union freedom. The protection of workers' rights to the employer and therefore the membership of the union they wish for, the separation from the membership of the union and the free trade-union activity within the legal boundaries must not be prevented at all and under no circumstances. Our work is called "Guarantee of Union Member". In the first part of our work we have included trade union concepts, elements of the union and the establishment of the union. In order for the trustees of the trade union to be learned, what is described in this chapter constitutes a beginning. In the second part, "trade union membership" has been examined by opening the topics that are considered important. The conditions of the trade union membership, membership procedures, members' rights and debts have been examined by comparing the old new law. The criticisms of the old regimes are also given in this section. The third part of our work has been examined under the heading " Assurance of Trade Union Membership" This title is the main theme of our work. This section examines the concepts of assurance, the employment of the worker, the duration of the work and the end of the employment contract, comparing the assurance of the trade union membership with the previous and new regulations, as well as opinions in the doctrine and decisions of the Court of Cassation.
